  • P2P & International Exchanges: The responsibility shifts to the buyer to deduct and deposit TDS. Failure to do so can lead to penalties.
  • Threshold: TDS applies if transactions exceed ₹50,000 in a year (or ₹10,000 for specific individuals like salaried employees).


New for 2025: The 60% Penalty & GST

  • Section 158B (Undisclosed Income): Introduced in Budget 2025, if the Tax Department finds unreported crypto during a search or audit, it is treated as "undisclosed income" and taxed at a massive 60% rate (plus surcharges), with zero deductions allowed.
  • 18% GST on Fees: While crypto itself doesn't have GST, the trading fees charged by exchanges (both Indian and International) now attract an 18% GST for Indian residents.


How to File: Schedule VDA in ITR

​When filing your Income Tax Return, you must use Schedule VDA.

  1. Form Selection: Use ITR-2 (for investors) or ITR-3 (if you trade professionally as a business).
  2. Disclosure: You must list every single transfer. Required fields include:
    • ​Date of Acquisition & Date of Transfer.
    • ​Cost of Acquisition.
    • ​Consideration Received (Sale Price).
  3. Reporting Losses: Even though losses cannot be offset, they must be reported in the Schedule VDA to ensure your records match the TDS data held by the IRS.
